By downloading, installing, or using Mindful Moments (the "App"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the App.
These terms apply alongside Apple's standard End User Licence Agreement (EULA), which also governs your use of apps downloaded from the App Store.
Mindful Moments is an iOS meditation and mindfulness application that provides guided meditation sessions, breathing exercises, mood tracking, journaling, progress tracking, and daily reminder notifications. The App is currently provided free of charge. Future versions may introduce optional paid features or subscriptions, which will be clearly disclosed before purchase.
Mindful Moments is designed for general wellness and relaxation purposes only. It is not a medical device, therapeutic tool, or substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment.
If you are experiencing a mental health crisis or have concerns about your physical or mental health, please contact a qualified healthcare professional or, in an emergency, call 111 (New Zealand) or your local emergency services.
The App is intended for users aged 4 and over. By using the App you confirm that you meet any applicable age requirements in your country or region.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, solely for your personal, non-commercial purposes. This licence does not include the right to:
All content within the App — including but not limited to the name "Mindful Moments", the app icon, design, graphics, audio, text, and code — is owned by or licensed to us and is protected by applicable intellectual property laws. Nothing in these terms grants you any right to use our intellectual property other than as set out in Section 5.
Any journal entries, notes, or other content you create within the App are stored solely on your device and remain entirely yours. We have no access to this content and take no ownership of it.
The App is currently free. If we introduce paid features, in-app purchases, or subscriptions in the future, we will update these terms and clearly communicate pricing, billing cycles, and cancellation terms before any charge is made. All in-app purchases will be processed by Apple and subject to Apple's payment terms.
We aim to keep the App available and up to date, but we do not guarantee that it will always be available, error-free, or uninterrupted. We may update, modify, or discontinue the App at any time without prior notice.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by New Zealand law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Nothing in these terms limits liability that cannot be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (New Zealand).
The App does not currently integrate third-party services. If this changes in future versions, any third-party terms that apply will be disclosed. The App is distributed via Apple's App Store, and Apple's terms apply to that distribution.
We may update these Terms & Conditions from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, provide notice within the App. Continued use of the App after changes are posted constitutes your acceptance of the updated terms.
These terms are governed by the laws of New Zealand. Any disputes arising from these terms or your use of the App will be subject to the exclusive jurisdiction of the courts of New Zealand.
